Joe Simpson - Jessica and Ashlee Simpson's father - was charged with two misdemeanor counts of driving under the influence on Tuesday, Access Hollywood has confirmed.
The 54-year-old's two counts carry a maximum penalty of 36 months of probation, six months in jail and $1000 fine for each charge, a spokesperson for the Los Angeles City Attorney told Access.

Simpson's counts would be combined if convicted on both, leaving him with up to six months in jail.
He is scheduled for arraignment on August 30.

As previously reported on AccessHollywood.com, Simpson was arrested at approximately 10:15 PM on August 4. He was stopped at Ventura Blvd. and Columbus Ave. in Sherman Oaks, Calif., a Los Angeles Police Department spokesperson told Access on Friday.
He was taken into custody and released the following day.
Simpson's bail was $5,000.
