The first of the two anonymous male massage therapists who filed sexual battery charges against John Travolta has withdrawn his lawsuit, CNN reports.
Okorie Okarocha, the lawyer representing both masseurs, filed papers Tuesday dropping the client identified as John Doe #1 because he incorrectly listed the date of the alleged incident at the Beverly Hills Hotel as January 16.

Instead of simply changing the date on the filing to January 15 -- the day John Doe #1 later claimed the event took place -- Okarocha chose to withdraw the allegation from the lawsuit, as it would have diminished the chances of winning John Doe #2's case, he told CNN.
On Tuesday, Travolta's lawyer, Marty Singer, issued a statement, saying: "We fully expect that my client will similarly be vindicated with respect to Doe #2, as well as with respect to any other person who makes meritless claims against John Travolta."

John Doe #2 alleged Travolta once groped him during a massage at an Atlanta hotel. According to Okarocha, "I can guarantee that John Doe #2 has a truckload of witnesses to back up what he's saying." John Doe #2 also has a series of e-mails in which he complained to his supervisor about Travolta's alleged advances.
After being dropped by Okarocha, John Doe #1 hired attorney Gloria Allred, E! News confirmed Wednesday.

"Mr. Doe's lawsuit was dismissed without prejudice, which means that he is still legally entitled to file a lawsuit against John Travolta if he chooses," Allred, 70, said in a statement. "We are in the process of conferring with him regarding the next steps, which he may wish to take. Our client and our firm has no further comment at this time."
Travolta, 58, has been married to actress Kelly Preston, 49, since 1991. She is the mother of his three children: Jett (1992-2009), Ella (born in 2000) and Benjamin (born in 2010).
